Eligibility Criteria
Who Qualifies for the Mental Health Court?
The Shelby County Mental Health Court (MHC) is designed for individuals whose criminal charges are closely linked to a diagnosed mental illness. Participation is voluntary and requires a commitment to treatment, accountability, and personal growth.
To be considered, participants must meet the following eligibility criteria:
- A diagnosed serious and persistent mental illness such as schizophrenia, bipolar disorder, or major depressive disorder.
- Facing non-violent misdemeanor charges or low-level felony offenses that are appropriate for diversion.
- Willing to participate in a structured treatment and recovery plan supervised by the Court.
- Voluntarily agree to enter the program and comply with its requirements.
Screening & Assessment
All potential participants undergo a comprehensive screening and assessment before being accepted. This process includes:
- Reviewing criminal charges to ensure they meet program guidelines.
- Evaluating mental health history and current treatment needs.
- Assessing willingness and capacity to engage in long-term recovery.
- Determining the likelihood of successful completion based on individual strengths and risks.
